Afterstate provides a digital legacy planning tool that allows users to record instructions for their digital accounts, assign trusted contacts, and prepare platform-specific request documentation. Afterstate is a preparation and documentation service only. We do not guarantee that any third-party platform will honor, process, or respond to requests submitted on your behalf or on behalf of your estate. Platform policies are outside our control and change without notice.

2. No Legal or Financial Advice

Nothing in this service constitutes legal, financial, estate planning, or tax advice. The information provided is for organizational and documentation purposes only. You should consult a qualified attorney or estate planner for legally binding estate planning instruments such as wills, powers of attorney, or trusts.

3. Limitation of Liability

To the maximum extent permitted by applicable law, Afterstate and its operators, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising from your use of or inability to use this service. This includes but is not limited to:

• Failure of third-party platforms to act on submitted requests
• Loss of data due to technical failure, cyberattack, or service discontinuation
• Delays in or failure of trusted contact notification
• Any harm arising from reliance on platform-specific legal notes provided in the application
• Inability of heirs or trusted contacts to access accounts or assets

In jurisdictions that do not allow exclusion of certain warranties or limitation of liability, our liability is limited to the amount you paid for the service, not to exceed the purchase price of your plan.

4. No Guarantee of Activation

Afterstate prepares documentation and instructions. Actual activation of your plan depends on your trusted contacts initiating the verification process, the availability of required legal documents such as a death certificate, the cooperation of third-party platforms, and the continued operation of this service at the time of activation. We make no guarantee that your plan will be activated or that activation will occur within any specific timeframe.

5. Sunset Clause — Service Discontinuation

If Afterstate decides to discontinue the service, the following process will apply:

• 90-day notice: All registered users will receive written notice via email at least 90 days before the service is shut down.
• Data export: During the notice period, every user will be provided with a full export of their stored data in a readable format (JSON or PDF) at no charge.
• Trusted contact notification: Registered trusted contacts will be notified of the service discontinuation so they are aware the platform will no longer be available.
• Data deletion: All user data will be permanently deleted within 30 days of the service shutdown date. A deletion confirmation will be sent to the registered email address.
• Lifetime checkout: Afterstate is preparing one-time lifetime checkout for launch. No subscription is created in this preview.
• Deceased users: For accounts where a verification process has been initiated, we will make reasonable efforts to complete pending requests or transfer documentation to the designated trusted contact before shutdown.

We reserve the right to transfer user data and service obligations to a successor entity rather than discontinuing the service entirely. In such cases, users will be notified and given the option to opt out of the transfer and request data deletion.

6. Preview Data Security

This preview build stores account setup data in your browser's local storage. Do not enter sensitive passwords, seed phrases, government ID numbers, financial account numbers, or other secrets. A production backend, server-side authentication, and audited storage controls are required before using Afterstate for sensitive customer data.

7. Platform Legal Notes

The legal notes displayed for each platform in the application are provided for informational purposes only. They reflect publicly known policies at the time of writing and may be outdated. Afterstate does not represent or warrant that these notes are accurate, current, or applicable to your specific jurisdiction or situation. Always verify current policies directly with the relevant platform or a qualified attorney.

8. Governing Law

These terms are governed by the laws of the jurisdiction in which Afterstate is incorporated. Any disputes shall be resolved through binding arbitration rather than in court, except where prohibited by law. You waive any right to participate in a class action lawsuit or class-wide arbitration.

9. Changes to Terms

We may update these terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of the service after that period constitutes acceptance of the revised terms.

What we collect

In this preview build, account setup data is stored locally in your browser. This can include your name, email address, chosen platform labels, trusted contact details, final note text, check-in timestamps, and checkout interest status. Do not enter sensitive credentials, seed phrases, government IDs, or financial account numbers.

What we never collect

Afterstate does not ask for platform passwords, seed phrases, government ID numbers, financial account numbers, or biometric data. Do not put those details into free-text fields.

How we use it

Preview data is used to let you test the product flow on this device and to record checkout interest if submitted. We do not sell or rent this data. A production release should replace local-only storage with a proper backend privacy model before handling sensitive customer data.

Your rights

You may request a full export of your data at any time. You may request permanent deletion of your account and all associated data. For GDPR users, you have the right to access, rectify, port, and erase your personal data. Contact privacy@afterstate.xyz for any data requests.

Your rights under GDPR and applicable law

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with data protection legislation, you have specific rights regarding your personal data. Afterstate respects and supports the exercise of these rights in full.

Right of access

You may request a copy of all personal data we hold about you at any time. This includes your profile information, platform records, trusted contact details, and check-in history. We will provide this within 30 days of a verified request at no charge.

Right to rectification

If any data we hold about you is inaccurate or incomplete, you have the right to have it corrected. Most information can be updated directly from your account dashboard. For data you cannot edit yourself, contact us and we will correct it within 14 days.

Right to erasure

You may request permanent deletion of your account and all associated data at any time. Once processed, deletion is irreversible and your plan cannot be recovered. We will confirm deletion within 30 days. Note: where we are required by law to retain certain records, those specific records will be anonymized rather than deleted.

Right to data portability

You may request a machine-readable export of your data at any time. Exports are provided in JSON format and include all account data, platform configurations, and your stored final message in encrypted form. Exports are available from your account settings or by contacting us.

Right to restriction and objection

You may request that we restrict processing of your data in certain circumstances, such as while a dispute about accuracy is resolved. You may also object to processing based on legitimate interests. We will honor such requests unless we have a compelling legitimate ground that overrides your interests.

How to exercise your rights

Send a request to privacy@afterstate.xyz from the email address registered to your account. We may ask you to verify your identity before processing sensitive requests. All requests are acknowledged within 72 hours and fulfilled within 30 days.

You also have the right to lodge a complaint with your local data protection authority if you believe your rights have not been respected.

What are cookies

Cookies are small text files stored on your device when you visit a website. They allow the site to remember information about your visit, such as your preferred language, login state, and session details. Afterstate uses cookies sparingly and only for functional purposes.

Strictly necessary cookies

These cookies are required for the platform to function. They cannot be disabled. They include session authentication tokens that keep you logged in during a visit, CSRF protection tokens that prevent cross-site request forgery, and preference cookies that store your language setting. These cookies contain no personally identifiable information beyond a session identifier.

What we do not use

Afterstate does not use advertising cookies, retargeting pixels, or third-party analytics trackers. We do not share cookie data with advertisers or data brokers. We do not use cookies to build a behavioral profile of any user. Our cookie footprint is intentionally minimal.

Analytics

We use privacy-respecting, cookieless analytics to measure aggregate page traffic and feature usage. This system does not use cookies, does not track individuals across sessions, and does not transmit data to third-party advertising networks. The data collected is used solely to improve the product.

Cookie duration

Session cookies: expire when you close your browser. Authentication cookies: expire after 30 days of inactivity or when you sign out. Language preference cookies: expire after 12 months.

Managing cookies
